Expected rate when TCDS pausing?

We are expecting rate (ER LM) when RunOngoing and L0 state is not in:
- fixingSoftError
- dcsPauseResume
- pausing
- paused
- resuming
- ttcHardResettingFromRunning
- ttcResyncingFromRunning
I noticed a case when TCDS is in pausing while L0 is still in running:
Should we consider TCDS states to say if we expect the rate? In this case Expected Rate condition would finish a little earlier.
